PUNK RADIO QUIZ LIVE SWEEPSTAKES OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN

1.         Eligibility:  The Punk Radio Quiz Live Sweepstakes (“Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age as of May 6, 2010.  Employees, officers, and directors of the Sponsor (defined below) and its affiliates, parents, subsidiaries, or advertising or promotion agencies that were involved in the conception, development or conduct of this sweepstakes, as well as their immediate household family members, are not eligible.  VOID WHERE PROHIBITED BY LAW.


2.         Entry:  No purchase or payment of any kind is necessary to enter or win.  To enter, text A or B to 97740. There is a maximum of 10 entries per person during the sweepstakes period. If you choose to enter by text message you will be required to double opt-in to the sweeps by replying YES. For your entry, you will be given a complimentary ringtone keyword. You can redeem your ringtone keyword by sending <keyword> to 97740. You may also participate via the Punk Radio Cast website ( www.punkradiocast.com ) without making a purchase or payment. Participants will be entered into the sweepstakes once for each text message vote that is received and confirmed with a text message response during the course of the promotion and/or once for each properly completed website entry received.  There is a limit of ten entries per participant.



Sponsor assumes no responsibility for any lost, stolen, missing, misdelivered, undelivered, misdirected, illegible, or late entries.  Incomplete entries will be void. All entries become the property of the Sponsor and will not be returned.  Sponsor also is not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on any applicable network. 



3.         Winner Selection:  Each individual promotion runs for a period of one week (7 days) beginning at 3pm on Friday E.S.T and ending at 2pm E.S.T the following Friday. The Sweeps shall begin on May 7th, 2010 and run until December 31st, 2010. An entry will be selected at random and the sender will be called and asked for the answer to the quiz question. A correct answer will win the prize (a check for $500) for that week’s promotion. If the sender gives an incorrect answer, another entry will be drawn at random and the process repeated until a winner is determined. 10 runners up will receive consolation prizes. Promotion organizer’s selection of the winner is final.


No assignment, transfer, or substitution of prize is permitted. All taxes and fees are the sole responsibility of the winner.  A list of all winners can be viewed at the Punk Radio Cast website.



4.         General Conditions: By participating, Participants agree to be bound by these Official Rules and the decisions of Sponsor, and waive any right to claim ambiguity in these Official Rules. All decisions regarding the Program, including, but not limited to, selecting Winners, will be made by Sponsor, whose decision shall be final.



5.         Consumer Disclosure:  NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE SWEEPSTAKES.  MAKING A PURCHASE OR PAYMENT WILL NOT AFFECT THE CHANCES OF WINNING.  The odds of winning will vary depending on the number of valid entries received.  The Sweepstakes is sponsored by Pop Monkey Productions, 7800 Beverly Blvd, Suite 231, Los Angeles CA 90036.


Sweepstakes entrants agree to be bound by the terms of these Official Rules.  Free copies of these Official Rules may be requested by sending a stamped, pre-addressed envelope to the following address: 7800 Beverly Blvd, Suite 231, Los Angeles CA 90036.  The laws of the United States govern this Sweepstakes.  All federal, state and local laws and regulations apply.  By entering, participants release and hold harmless Sponsor and its subsidiaries, affiliates, directors, officers, prize suppliers, employees, and agents from any injuries, loss, damage or liability of any kind arising from or related to the Sweepstakes or the acceptance or use of any prize won.


Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules or in violation of applicable laws; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, defraud or harass any other person.


6.         Limitation of Liability: Sponsor is not responsible for any incorrect or inaccurate information, however caused, which may occur in the processing of entries or other submissions in the Sweepstakes.  If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes.


ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
IN NO EVENT WILL SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, ITS ADVERTISING OR PROMOTION AGENCIES OR ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, LOST PROFITS OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS SWEEPSTAKES OR YOUR PARTICIPATION IN THIS SWEEPSTAKES.  SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.


7.         Use of Sweepstake Information:  Sponsor reserves the right to use any and all information related to the Sweepstakes, including information on entrants obtained through the Sweepstakes, for marketing purposes or any other purpose, unless prohibited by law.


8.         Governing Law:  This Sweepstakes and the rights and obligations of the Sponsor and participants will be governed by and controlled by the laws of the State of California applicable to contracts made and performed therein without reference to the applicable choice of law provisions.  All actions, proceedings or litigation relating in any way to the Sweepstakes shall be instituted and prosecuted solely within the State of California, Los Angeles County.  The parties consent to the jurisdiction of the state courts of California and the federal courts located within such state and county with respect to any action, dispute or other matter pertaining to or arising out of the Sweepstakes.
